1. Agreement to Terms

These Terms and Conditions (“Terms”) govern your access to and use of the PostZam website, applications, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Definitions

“Content” means any video, image, audio, caption, hashtag, metadata, link, or other material you upload to or distribute through the Service.

“Third-Party Platform” means any social network you connect to the Service, including Meta/Facebook/Instagram, TikTok, YouTube, X, and LinkedIn.

“Credits” means the prepaid digital units you purchase and spend to use features of the Service, including platform posting and AI features.

“Session” means one video upload and distribution event.

“AutoPost” means PostZam’s proprietary delivery system that applies platform-specific timing, formatting, and safety rules designed to protect your account and align with each platform’s posting guidelines.

“AI Caption Engine” means PostZam’s artificial intelligence system that analyzes your uploaded video and any instructions you provide to generate captions, hashtags, and related content tailored to each platform.

“AI Enhanced” means AI features are active by default. You can switch to “User Created” mode at any time to write your own captions manually.

3. Eligibility and Account Registration

•       You must be at least 18 years old and legally able to enter into a binding contract.

•       You agree to provide accurate registration information and keep your email address current.

•       PostZam uses a 6-digit email verification code to authenticate your account and secure sign-ins.

•       You are responsible for maintaining access to your registered email and for all activity under your account.

•       Notify us at admin@postzam.com of any suspected unauthorized access.

4. The Service

PostZam is a software service that helps you publish your video content to multiple social platforms from a single upload. PostZam is not affiliated with, endorsed by, or associated with any Third-Party Platform.

We do not control Third-Party Platforms, their availability, moderation decisions, algorithms, rate limits, or policy enforcement. We do not guarantee that your Content will be accepted, posted, remain posted, or achieve any reach, engagement, or revenue outcome.

5. Connecting Third-Party Platforms

•       You connect your social accounts to PostZam using each platform’s official authorization system.

•       PostZam stores the authorization tokens each platform issues so we can post your Content at your direction.

•       Your authorization tokens are encrypted and are never shown in logs, error messages, support tickets, or any user-facing screen.

•       You can disconnect any platform at any time from within your PostZam account.

•       You must comply with each platform’s rules. You may not use PostZam to bypass platform rules, perform prohibited automation, or manipulate engagement.

•       Third-Party Platforms may change, limit, or revoke access at any time. PostZam is not liable for interruptions caused by platform changes.

6. Credits, Plans, and Billing

PostZam operates on a prepaid credit model. You purchase credits in advance and spend them as you use the Service. Credits are digital units with no cash value and may not be transferred, sold, or redeemed for cash.

Plans

PostZam offers the following monthly plans, each including a set number of credits. Specific credit quantities are published on postzam.com and may be updated with notice.

•       The Tester — $19.99 per month — XXX credits

•       Internet Pro — $59.99 per month — XXX credits

•       Business Class — $99.99 per month — XXX credits

•       Elite — $149.99 per month — XXX credits

•       Pro Influencer — $199.99 per month — XXX credits

How Credits Work

•       Credits are deducted at the time each action is initiated.

•       PostZam displays the credit cost of each action before it executes. If your balance is insufficient, the action will not proceed and no credits will be deducted.

•       Unused credits carry over month to month while your account remains active, up to a cap of two times (2x) the monthly credit quantity of your current plan. Example: if your current plan includes 1,000 credits per month, you may carry a maximum balance of 2,000 credits.

•       PostZam also offers one-time credit top-up purchases for users who run out of credits between billing cycles. Top-up packs are priced at a higher cost-per-credit than subscription plans. Current top-up pricing is displayed at the time of purchase and on postzam.com.

•       PostZam reserves the right to adjust credit prices and plan quantities with advance notice to users prior to their next purchase.

Payment Processing

Payments are processed by Authorize.net, a PCI-compliant payment processor, through our direct merchant account with Chase. PostZam does not store full payment card numbers, CVV codes, or magnetic stripe data. All card data is tokenized and handled exclusively by Authorize.net.

Charges on your bank or card statement will appear under one of the following names:

•       Power Med dba Post Zam

•       PostZam

•       Power Med LLC

If you do not recognize a charge, please contact billing@postzam.com before contacting your bank. We resolve billing questions quickly.

All credit purchases are final and non-refundable except where required by applicable law or as described in Section 7.

7. Refund Request Process

PostZam is a customer-service-first company. If you are dissatisfied or do not recognize a charge, please contact us directly before filing a dispute with your bank.

Good-Faith Billing Error Window

If you believe a charge was made in error, contact billing@postzam.com within seven (7) days of the charge. Good-faith billing errors identified within this window are reviewed on an expedited basis. Typical good-faith billing errors include duplicate charges, charges after account closure, and charges that do not match the plan selected.

All Other Refund Requests

To request a refund or resolve a billing issue:

•       Email billing@postzam.com

•       Include your full name, account email, order ID or transaction date, reason for the request, and your desired resolution

•       PostZam targets a response within 4 business hours during standard operations

•       Direct resolution is typically faster than a bank dispute, which can take up to 90 days

Refund requests are reviewed case by case in accordance with card network guidelines. PostZam is not obligated to issue refunds except where required by applicable law. Credits already consumed are not refundable. Unused credits from a current billing cycle may be considered for partial refund at PostZam’s discretion within the 7-day good-faith window.

8. Acceptable Use

You may use the Service only for lawful purposes and in compliance with these Terms and all applicable laws. You will not:

•       Violate any law, regulation, or court order

•       Upload or distribute Content that infringes intellectual property, privacy, publicity, or other rights

•       Distribute malware or attempt unauthorized access to any system

•       Interfere with, disrupt, overload, or degrade the Service

•       Use the Service for spam, deceptive practices, coordinated inauthentic behavior, or engagement manipulation

•       Scrape or harvest data from the Service or from Third-Party Platforms through the Service

•       Reverse engineer, decompile, or attempt to derive source code except where permitted by law

•       Attempt to circumvent the credit system, manipulate credit balances, or exploit billing errors

•       Post illegal, adult, gambling, hateful, extremist, or deceptive content

9. AI Features, AutoPost, and Your Responsibility

AI Caption Engine

PostZam’s AI Caption Engine analyzes your uploaded video and any instructions you provide to generate captions, hashtags, and related content for each selected platform. The engine is designed to produce content based only on what appears in your video, what you provide in any link you supply, or what you literally type in your instructions. The engine applies each platform’s character limits and formatting rules automatically.

AI Enhanced vs. User Created

AI Enhanced mode is the default setting. You can switch to User Created mode with one tap to write your own captions manually. You control which mode is active on every post.

AI Thumbnail Creation

PostZam’s AI thumbnail feature generates thumbnail images for your video content. You are responsible for reviewing and approving all generated thumbnails, and for ensuring they comply with platform policies and applicable law.

AutoPost System

AutoPost applies platform-specific delivery rules, safe timing windows, and compliance checks designed to align with each platform’s posting guidelines. AutoPost is designed to reduce spam risk and protect your account. PostZam does not guarantee that AutoPost will prevent account suspension or policy actions by Third-Party Platforms.

AI Disclaimer

AI features are tools to assist you. PostZam makes no warranty that AI-generated content will be accurate, appropriate, platform-compliant, or effective. You retain full responsibility for all content posted through the Service.

10. Content and Your Responsibility

You retain ownership of your Content. You are solely responsible for your Content, including its legality, accuracy, and compliance with Third-Party Platform rules.

You represent and warrant that you own or have obtained all rights, permissions, and consents necessary to upload and distribute your Content.

Content must not include unlawful, infringing, defamatory, harassing, hateful, adult, gambling-related, or otherwise prohibited material.

PostZam does not proactively review all user content. PostZam does monitor for indicators of spam, excessive automation, coordinated inauthentic behavior, deceptive activity, copyright abuse, or other conduct that could expose PostZam, platforms, or processors to risk. Enforcement actions may include warnings, feature restrictions, suspension, or termination.

11. In-App Video Capture

PostZam offers an in-app option to record video directly through your device camera and microphone. If you use this feature, you will be asked to grant permission to your camera and microphone. You may revoke these permissions at any time through your device settings.

Videos recorded in-app are processed the same way as uploaded videos. EXIF and technical metadata are automatically stripped before processing.

12. License to Operate the Service

You grant PostZam a limited, non-exclusive, worldwide, revocable license to host, store, process, transmit, and distribute your Content solely as necessary to provide the Service, including transmitting your Content to Third-Party Platforms at your direction.

This license ends when you delete your Content, except that we may retain limited copies for backups, security, dispute resolution, and legal obligations.

13. Intellectual Property and Feedback

The Service — including software, design, text, graphics, trademarks, the PostZam name and logo, AutoPost, AI Caption Engine, and all related intellectual property — is owned by PostZam and Power Med LLC or its licensors. The PostZam trademark application is filed with the United States Patent and Trademark Office under Power Med LLC. No rights are granted to you except those expressly stated in these Terms.

If you provide suggestions, ideas, or feedback, you grant PostZam a perpetual, worldwide, royalty-free license to use and incorporate them without compensation.

14. Privacy and Data Security

Our collection and use of personal information is described in our Privacy Policy at postzam.com. By using the Service, you consent to that collection and use.

•       All authorization tokens connecting your social accounts to PostZam are encrypted and never exposed in logs, error messages, or user-facing interfaces.

•       PostZam automatically strips EXIF and technical metadata from uploaded and in-app recorded videos before processing.

•       PostZam does not sell your personal data.

•       We implement reasonable administrative, technical, and physical safeguards, including encryption in transit (TLS) and encryption at rest where feasible. No system can be guaranteed 100% secure.

15. Posting Results and Status Transparency

Each platform’s posting result — success, failure, or in progress — is shown independently on the results screen. If a platform fails, PostZam displays the reason in plain English with an option to retry that platform.

PostZam’s real-time API monitoring alerts you to platform disruptions in plain English. If a platform is experiencing degraded service, you will see a clear notification.

16. DMCA and Copyright Complaints

PostZam respects intellectual property rights and responds to valid notices of alleged infringement. Repeat infringer accounts may be suspended or terminated. Copyright complaints should be submitted to admin@postzam.com and should include identification of the copyrighted work, identification of the allegedly infringing material, your contact information, and a statement of good-faith belief.

17. Service Availability and Changes

We may modify, suspend, or discontinue any part of the Service at any time. We may also add or remove features, supported platforms, or integrations.

New social platforms added to PostZam are available to all active users at no additional credit cost unless otherwise stated at the time of addition.

Future PostZam app add-ons may be offered as separate subscriptions or add-on purchases. Availability and pricing for any future add-ons will be published on postzam.com.

Some features may be labeled beta or preview and may be unstable or incomplete. Beta features are provided as-is.

PostZam performs backups and maintains reasonable recovery procedures. While we aim for high availability, uninterrupted service is not guaranteed.

18. Support and Communications

PostZam provides support through the in-app support channel and via email at support@postzam.com. We target a response time of 4 business hours but do not guarantee this timeframe.

You consent to receive service-related communications (such as security alerts, billing notices, low credit alerts, and policy updates) via email or in-product notices. You may opt out of marketing communications at any time.

PostZam notifies you when your credit balance runs low. It is your responsibility to purchase additional credits to continue using the Service.

19. Suspension and Termination

We may suspend or terminate your access immediately if we reasonably believe you have violated these Terms or platform rules, your use poses security or legal risk, we are required to act by a platform or processor, or you are engaging in fraud or abuse.

You may close your account at any time by contacting support@postzam.com. Upon account closure, remaining unused credits are forfeited and are non-refundable except where required by law.

Upon termination, your right to use the Service stops immediately. Sections covering intellectual property, disclaimers, limitation of liability, indemnity, and dispute resolution survive termination.

20. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” POSTZAM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

POSTZAM DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT YOUR CONTENT WILL BE SUCCESSFULLY POSTED TO ANY THIRD-PARTY PLATFORM.

POSTZAM DOES NOT WARRANT THAT AI-GENERATED CAPTIONS, HASHTAGS, OR THUMBNAILS WILL BE ACCURATE, APPROPRIATE, OR COMPLIANT WITH ANY PLATFORM’S POLICIES OR APPLICABLE LAW. YOU ARE RESPONSIBLE FOR REVIEWING AND APPROVING ALL AI-GENERATED CONTENT BEFORE POSTING.

POSTZAM DOES NOT WARRANT THAT AUTOPOST WILL PREVENT ACCOUNT SUSPENSION, RATE LIMITING, OR ANY OTHER ACTION BY A THIRD-PARTY PLATFORM.

21. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSTZAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR LOSS OF DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

POSTZAM’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO POSTZAM IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

22. Indemnification

You agree to defend, indemnify, and hold harmless PostZam and its owners, officers, directors, employees, and agents from any claims, damages, liabilities, and expenses arising from your Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

23. Dispute Resolution and Arbitration

Except where prohibited by law, any dispute arising out of or relating to the Service or these Terms will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules before a single arbitrator in Pinellas County, Florida.

YOU AND POSTZAM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Either party may seek injunctive relief in court to protect intellectual property or prevent unauthorized access or misuse.

24. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules, except to the extent preempted by federal law. Where arbitration is not applicable, disputes will be brought in the state or federal courts located in Pinellas County, Florida.

25. Export Controls and Sanctions

You may not use the Service if you are located in, or are a national or resident of, any country subject to U.S. embargo, or if you are listed on any U.S. government restricted party list.

26. Assignment

PostZam may assign these Terms without restriction. You may not assign these Terms without PostZam’s prior written consent.

27. Severability and Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. These Terms, together with our Privacy Policy and any posted policies, constitute the entire agreement between you and PostZam regarding the Service.

28. Updates to These Terms

PostZam may update these Terms from time to time. Material changes will be communicated via the Service or email with reasonable advance notice. Continued use of the Service after updates constitutes acceptance of the updated Terms.
